Legal Battle Brews Over ATF’s Controversial Firearms Regulation

Payam Javan: Four Republican-led states—Louisiana, Mississippi, Texas, and Utah—have filed a motion in a Texas court to block a new rule from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) redefining who is “engaged in the business” of dealing firearms.

This rule, set to be effective on May 20, has sparked controversy, with critics arguing it could impact private transactions and inheritance of firearms. The states argue the rule violates the Fourth Amendment and seek a temporary restraining order. This motion follows a lawsuit filed by other states against the ATF and Attorney General Merrick Garland, alleging overreach and infringement on Second Amendment rights. The National Rifle Association has supported these legal challenges.
