Payam Javan: U.S. President Donald Trump has signed two executive orders aimed at restricting automatic birthright citizenship for children born in the United States under specific circumstances, particularly focusing on commercial birth tourism. The measures represent a significant shift in immigration policy, seeking to tighten the interpretation of the 14th Amendment regarding who qualifies for automatic citizenship at birth.
One of the key directives explicitly bans the practice of birth tourism, where foreign nationals travel to the United States on tourist visas with the primary intent of giving birth so their children receive automatic U.S. citizenship. During the signing ceremony, Trump characterized the current application of birthright citizenship as a systemic vulnerability that has been exploited, describing the situation as a serious issue requiring immediate executive intervention.
The executive actions follow a June ruling by the U.S. Supreme Court, which struck down a previous attempt by the administration to exclude the children of undocumented immigrants and temporary legal visitors from automatic birthright citizenship. Trump described the judicial decision as highly unfortunate and indicated that the new executive orders represent necessary administrative adjustments to address those legal hurdles.
Explaining the legal and historical rationale behind the orders, Deputy Chief of Staff for Policy and Homeland Security adviser Stephen Miller argued that the 14th Amendment was originally ratified post-Civil War solely to guarantee citizenship to the children of formerly enslaved people. According to Miller, one of the new orders will expand the categories of individuals ineligible for birthright citizenship to include foreign adversaries, members of designated terrorist organizations, and individuals acting on behalf of foreign governments.
Miller further detailed the second executive order, which targets individuals who allegedly abuse tourist visas to secure citizenship and subsequent access to social benefits for their children. Trump echoed these concerns, asserting that wealthy individuals had established commercial enterprises around birthright citizenship, a practice he condemned as an abuse of the nation’s legal and economic systems.
The administrative actions have drawn sharp criticism from political opponents, including Representative Yassamin Ansari, a Democrat from Arizona, who publicly condemned the policy initiatives. Ansari argued that attempts to dismantle birthright citizenship are unlawful and called for investigations into the key officials, including Miller, who are driving these restrictive immigration measures.
Parallel to the federal directives, state-level crackdowns have also intensified, with Texas Governor Greg Abbott issuing an executive order targeting birth tourism within the state’s healthcare sector. Abbott’s directive instructs the Texas Health and Human Services Commission and medical licensing boards to investigate healthcare providers suspected of facilitating birth tourism schemes, following previous investigations into hospitals marketing birth packages to foreign nationals.
