Santa Clara County Announces Operation Second Chance: Opportunity to Resolve Non-Violent Misdemeanor Warrants Without Jail Time

Payam Javan: This holiday season, the Santa Clara County Sheriff’s Office, in collaboration with all other local law enforcement agencies, is offering individuals with qualifying non-violent misdemeanor warrants a chance to avoid jail time through the Operation Second Chance program.

Starting December 1, 2024, and continuing throughout December, eligible individuals can receive a citation with a new court date instead of being booked into County Jail.

Program Details:

  • Individuals with qualifying misdemeanor warrants can visit any Santa Clara County law enforcement agency to receive a citation, including a “Promise to Appear” court date, acknowledged in writing.
  • The program applies to most misdemeanor warrants, regardless of bail amount, except:
    • Felony warrants
    • Warrants marked “No Cite and Release”
    • Warrants involving violence (e.g., domestic violence), firearms, resisting arrest, or false information to a peace officer.

Reminder:
Individuals with ineligible warrants are encouraged to resolve their cases in court.

Program Success:
Between 2007 and 2017, over 3,500 people participated in Operation Second Chance. This year, a change has been made to exclude warrants marked “No Cite and Release.”
