Press release regarding an in-custody death at the Elmwood Correctional Facility

Payam Javan: On 5/16/2024, at approximately 10:08 AM deputies assigned to the Elmwood Correctional Facility in Milpitas located an unresponsive 41-year-old man in his assigned barrack. Deputies and medical staff immediately performed life-saving measures on the individual by administrating CPR until medical personnel arrived.

At approximately 1030AM, the Milpitas Fire Department and Emergency Medical Services arrived on scene and pronounced the adult male deceased at 1050AM. Sheriff’s Office Detectives responded to the scene to conduct an investigation. Preliminary information showed no evidence of foul play leading to the death. The Medical Examiner Coroner’s office is investigating the cause and manner of death.

The decedent was booked into the Santa Clara County Main Jail on 12/05/2023 to await trial for allegations of felony sexual assault charges.

The Sheriff’s Office is following standard protocol for an in-custody death by conducting a joint investigation among the Sheriff’s Office, District Attorney’s Office, and the Santa Clara County Medical Examiner-Coroner’s Office. The name of the decedent is being withheld until notification to next of kin.
