Investigation Underway: Inmate’s Death at Elmwood Correctional Facility

Payam Javan: On 6/26/2024, at approximately 2:38 P.M., deputies assigned to the Elmwood Correctional Facility in Milpitas located an unresponsive 49-year-old man in his assigned cell while conducting a routine welfare check. Deputies and medical staff immediately performed lifesaving measures on the individual by administrating CPR until medical personnel arrived.

At 2:46 P.M., the Milpitas Fire Department and Medical Services arrived on scene and transported the man to a local hospital for further assessment. On 6/28/2024, at approximately 1:46 A.M., the incarcerated male was pronounced deceased while in the care of a local hospital.

Sheriff’s Office Detectives responded to both the Elmwood Correctional Facility and the hospital to conduct an investigation. Preliminary indications are suicide and no evidence of foul play leading to the death.

The decedent was booked into the Santa Clara County Main Jail on 6/23/2024 by the San Jose Police Department for several outstanding warrants, multiple drug charges, and resisting arrest.

The Sheriff’s Office is following standard protocol for an in-custody death by conducting a joint investigation among the Sheriff’s Office, District Attorney’s Office, and the Santa Clara County Medical Examiner – Coroner’s Office. The name of the decedent is being withheld until
notification of next of kin.
