Ninth Circuit Greenlights New Firearm Restrictions in Hawaii and California

Payam Javan: On September 6, the U.S. Ninth Circuit Court of Appeals issued a ruling on the constitutionality of firearm restrictions in Hawaii and California, partially reversing a lower court’s temporary block on enforcing new laws. The appellate court allowed bans on carrying firearms in bars, restaurants serving alcohol, parks, and adjacent parking areas to take effect. This decision reflects a nuanced approach to balancing Second Amendment rights with public safety concerns in these states.

The court upheld injunctions that block gun bans from taking effect at specific locations including financial institutions, hospitals, public transit, and other areas in California. This means that while some restrictions are enforced, others, particularly those affecting sensitive or public areas, remain under judicial review. The ruling emphasized the need for a historical context in assessing modern firearm regulations, referencing the 2022 Supreme Court decision in New York State Rifle & Pistol Association v. Bruen.

The legal challenges centered on Hawaii’s Act 52 and similar California legislation, which restricted firearms in various “sensitive places.” The Ninth Circuit’s decision highlighted inconsistencies in historical precedents for firearm bans but noted that some restrictions, like those in parks, align with long-standing practices.
